/01 Contracting entity

For clients in Malaysia, services are provided by [Malaysian legal entity] ([SSM registration number]), [Malaysian address]. All other terms are in the Master Services Terms.

/02 Prices and tax

Prices are in Malaysian Ringgit and exclude Sales and Service Tax. Service tax is charged at the applicable rate where our services are taxable services and we are registered. Withholding tax that the Income Tax Act 1967 requires you to deduct must be paid to the Inland Revenue Board on time, with proof provided; otherwise it remains payable as fees.

/03 Payment

Invoices are due within 7 days. Late amounts carry interest at 1.5% per month, and you pay reasonable recovery costs, including legal costs on a solicitor-and-client basis.

/04 Electronic contracts

Acceptance by electronic means forms a binding contract under the Electronic Commerce Act 2006 and the Contracts Act 1950.

/05 Data protection

Each party complies with the Personal Data Protection Act 2010 as amended by the Personal Data Protection (Amendment) Act 2024. Mr.Ooi acts as your data processor under the Data Processing Agreement. See the Malaysia Privacy Notice.

/06 Governing law and arbitration

These Terms are governed by the laws of Malaysia. After the 30-day senior discussion, any dispute will be finally resolved by arbitration under the AIAC Arbitration Rules of the Asian International Arbitration Centre, before one arbitrator, seated in Kuala Lumpur, in English, under the Arbitration Act 2005. Mr.Ooi may in addition sue for undisputed unpaid fees in the Malaysian courts.
